§1 Contract conclusion
1.. The material depicted on the website of the seller under the url www.adivarius.de as well as in any other publications or customer related material constitutes a suggestion to the customer to send an offer of purchase to the seller. The customer can relate his order to the seller online by filling in the respective forms or via phone or telefax.

2. The contract between the customer and the seller is concluded only when the seller sends out an order confirmation or at the latest when the customer receives the goods and services ordered.

§2 Reservation of proprietary rights
All ordered goods remain the property of Adivarius until full payment is rendered.

§3 Right of revocation and return
1. If the customer is a consumer in the sense of these terms and conditions, he can revoke his contract within a time limit of two weeks without stating any reasons. The revocation has to be in written form (letter, fax, e-mail) or by returning the purchased goods. The time limit begins at the earliest when the customer receives the goods and corresponding information about his right of revocation and return. The time limit is observed when the written statement of revocation or the goods are sent to the seller within the two week period. The revocation has to be sent to the address specified under ‘contact information’.

2. In case of a valid revocation, any services rendered by the two parties have to be returned. This also applies to any additional benefits received or made (e.g. interest). If the customer is unable to return the purchased goods and services completely or returns them only partly or in an impaired state, he has to compensate the seller for the resulting loss of value. This does not apply if the impairment of the goods is due only to their assessment, comparable to the assessment possible in a store.

3. Items that can be sent by mail are strictly to be returned at the cost and risk of the seller. If the order value of the returned goods does not exceed 40 Euros, the customer has to bear the costs of postage, if the goods received are as ordered. Otherwise the seller has to bear the costs. If the purchased goods are not transportable by mail they will be picked up.

4. Sound storage media are excluded from the right of revocation and return.

§4 Method of Payment and Delivery Period
After the order has been received, the customer will receive a conformation by e-mail containing the data relevant to the purchase and the seller’s bank details. After the receipt of payment the ordered goods will usually be mailed within a time limit of two to three working days.
